Last week, according to the arrangement of the provincial Administration of Foreign Experts Affairs, Hangzhou began to implement the newly revised Guide of Zhejiang to Work Permit Service for Foreigners in China (ZWZF 2019 No. 9 document) and provide foreign talents with more convenient services for their innovation and entrepreneurship in Hangzhou. We will update the answers to the frequently asked questions encountered by employers after the implementation of the new edition of Service Guide regularly.

 

1. What does acceptance with absence of some materials mean during the application for Notification of Work Permit for Foreigners?


Policy interpretation: In applying for a work permit for foreigners of Category B in China, the employer may apply for application with absence of some materials for the certification of the embassy or consulate on no criminal conviction, and provide related letters of commitment according to the template of the aforesaid Service Guide. Before the entry, they need not provide paper materials and original copy for verification. But after the entry, they need to supplement all required materials in the “administrative service system for foreigners working in China” when claiming the Work Permit for Foreigners and submit the paper materials and original copy for verification.


Warm reminder: Each employer should supplement all required materials within the deadline as required in applying for a work permit for foreigners in the form of “acceptance with absence of some materials” and “letters of commitment”. If it cannot provide corresponding evidentiary materials, the administrative permit will not be provided.

 

2.The certification of no criminal conviction is required for the application for a work permit for foreigners (to work in China for less than 90 days, including 90 days). What are the specific requirements?


Policy interpretation:


(1)The no criminal conviction should be issued by departments of the native country or permanent residence of the applicant such as police station, security department or court and be certified by Chinese embassy or consulate abroad or a foreign embassy or consulate in China.


(2) The no criminal conviction issued by Hong Kong and Macau Special Administrative Regions or Taiwan China should be notarized by a local notary organ.


(3) The no criminal conviction should have been signed and issued for within six months.


Warm reminders: The no criminal conviction requirement has been introduced for the short-term work permit in China. Each employer should submit related materials to the “administrative service system for foreigners working in China” following the requirements of the Service Guide for later employment of foreign talents.
